What do I do in case of a divorce or the end of registered partnership

Divorce or the end of a relationship. Divorce or the end of a registered partnership is never nice, but it becomes more difficult when issues are not sorted out properly. A marriage or registered partnership gives both partners equal rights to the home because both are legal joint tenants. If the relationship ends, and one of the partners wish to remain in the home, then the partner who moves out must end his or her part in the tenancy. The circumstances for both partners are changing so both need to sign the request to end the tenancy. Once this has been finalised, the person who has left the property is no longer liable for the terms of the tenancy agreement. All liability is with the remaining partner.

If no consensus can be reached about who will stay in the home, the case will be referred to the district court which will decide who can continue the tenancy.
